In BriefDue to disparities between the single and married-filing-jointly thresholds for tax brackets, phaseouts, and various other provisions throughout the tax code, taxpayers often find themselves paying higher taxes after getting married and filing jointly than they would have if they remained single and continued to file separately. Dubbed the “marriage penalty,” this aspect of the tax code has long been criticized by some, and as a result Congress has several times attempted to mitigate or eliminate it. The authors examine how the Tax Cuts and Jobs Act of 2017 has affected the marriage penalty, noting where it has been reduced or eliminated, and where it remains intact.
