NYS Provides Guidance for Missing Corporate Tax Forms

nysimageUPDATE, 3/1/16: NYC has posted corporate tax forms for non-combined filers. Forms for combined filings remain absent. The NYC Department of Finance is still advising business taxpayers to file for an extension given the short time frame between now and the 3/15 deadline. 

While state corporate partnership tax forms remain absent, the New York State Department of Taxation and Finance issued guidance today on what people should do until they become available: 

"If the forms you need to file your Article 9-A corporate franchise tax return and MTA surcharge return for 2015 are not yet available to be e-filed, you must electronically file the appropriate request for a six-month extension to file: Form CT-5, Request for Six-Month Extension to File (for franchise/business taxes, MTA surcharge, or both), Form CT-5.3, Request for Six-Month Extension to File (for combined franchise or combined MTA surcharge return, or both) or Form CT-5.4, Request for Six-Month Extension to File New York S Corporation Franchise Tax Return." 

The missing forms have been a source of frustration for tax practitioners throughout the state. Further complicating things, New York City is missing its own corporate tax forms. The city government has advised business taxpayers to file an extension before the March 15 deadline. 

Richard Dauman, chair of the Society's New York, Multistate and Local Taxation Committee, said on Exchange--the Society's exclusive social media platform--that the NYSSCPA is aware of the issue and is in communications with both New York state and the city to get updated information so practitioners can make plan accordingly. He added that any updates on the situation will be communicated through Exchange and the Society's website.
