COMMITTEE ACTION PLAN (CAP)
Who We Are
The Mediation and Arbitration Committee administers the Society's mediation and arbitration program, which assists in the resolution of disputes between or among Society members. It also encourages members to become qualified alternative dispute resolution ("ADR") neutrals in business disputes and advocates public acceptance of CPAs as qualified ADR neutrals.
What We Do
The following are some of the responsibilities of the Committee:
- To encourage the use of ADR by Society members as an orderly, economical and expeditious means of settling disputes
- To administer the Society's mediation and arbitration program, including without limitation
- Establishment of minimum requirements for CPA members serving as qualified neutrals participating in the program.
- Maintenance of a directory of CPA members meeting those qualifications to participate as neutrals for the program.
- Drafting appropriate rules to govern mediations and arbitrations under the auspices of the program.
- The acceptance of cases for mediation or arbitration and the submission to the parties of a list of at least six qualified neutrals drawn from such directory.
- Reporting at least annually to the Executive Committee or Board of Directors on the state of the program.
- To develop and provide education programs on ADR
- To encourage and train members to become qualified ADR neutrals
- To develop programs to educate the public about the qualification and capabilities of members to act as dispute resolution neutrals, and
- To stimulate awareness of ADR methodologies and the member's role in providing these services through the publication of articles in The CPA Journal, The Trusted Professional and other appropriate media
Who Should Join
Membership on the committee is open to all members who believe in ADR as an effective way to resolve disputes, and who want to provide the Society members with economical access to these services to resolve member-to-member disputes and to educate the membership and the public about ADR characteristics, processes and the advantages of using a Society member as a neutral.
Benefits of Committee Membership
The following are among the benefits of membership on the Committee:
- The ability to network with other members who are interested in ADR and to expand her/his knowledge of the ADR process
- The opportunity to help Society members resolve their disputes with each other
- The opportunity to participate as a panel member in committee seminars, and
- Access to other resources to assist the Committee member in writing and publishing articles on ADR.
